Terms of Service

1. Who we are

AOservices ("AOservices", "we", "us", "our") is a service operated by Otis Moras-Young, a sole trader based in Australia ("the Seller"). By accessing or using AOservices (the "Service"), you ("you", "the User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility & authority

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. If you use the Service on behalf of an organisation, you warrant that you have authority to bind that organisation to these Terms.

3. The Service

AOservices provides AI-powered customer support agents that are trained on materials you supply (e.g. website content, documentation, FAQs) and embedded on your website to respond to end-user enquiries. Specific deliverables, scope, and ongoing service levels are described on the pricing page or in your order at checkout.

4. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date. Notify us immediately of any unauthorised access.

5. Acceptable use

You must not, and must not permit any third party to:

  • use the Service for any unlawful, fraudulent, infringing, or abusive purpose;
  • upload content that infringes intellectual property, privacy, or other rights;
  • use the Service to send spam, malware, or harassing material;
  • probe, scan, scrape, reverse-engineer, or otherwise interfere with the Service;
  • resell, sublicense, or redistribute the Service without our written consent;
  • circumvent technical limits, rate limits, or security measures; or
  • attempt to "jailbreak" the AI to produce illegal, hateful, deceptive, or harmful content.

6. AI outputs & accuracy

The Service includes generative AI features. AI outputs may be inaccurate, incomplete, biased, or out of date and must not be relied on as professional, legal, medical, financial, or other regulated advice without independent verification by a qualified human. You are responsible for reviewing outputs before relying on them, for any decisions you make based on them, and for the prompts and content you submit. You must have all necessary rights to any content you provide for training or processing.

We may apply content moderation, refuse or filter outputs, restrict abusive prompts, and suspend accounts that misuse the AI features.

7. Intellectual property

The Service, including all software, models, prompts, design, branding, and documentation, is owned by the Seller or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose during your active subscription. You retain ownership of content you upload and grant us a limited licence to host, process, and display that content solely to provide the Service. If you submit feedback, you grant us a perpetual, royalty-free licence to use it to improve the Service.

8. Payment, billing & subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns. Payment, billing, currency, taxes, invoicing, and chargeback handling are governed by Paddle's Buyer Terms.

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time through Paddle's customer portal; access continues until the end of the current paid period.

9. Refunds

Refunds are governed by our Refund Policy. Refund requests are processed by Paddle as the Merchant of Record.

10. Suspension & termination

We may suspend or terminate your access immediately if you materially breach these Terms, fail to pay, create security or fraud risk, or repeatedly violate acceptable use. You may stop using the Service at any time. On termination, your licence to use the Service ends and we may delete your account data after a reasonable export window.

11. Service availability & warranties

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI outputs will be accurate or fit for any particular purpose. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes any consumer guarantee that cannot be excluded under applicable law (including the Australian Consumer Law).

12. Limitation of liability

To the maximum extent permitted by law, the Seller's total aggregate liability arising out of or relating to the Service or these Terms is limited to the amounts actually paid by you to Paddle for the Service in the three (3) months immediately before the event giving rise to the claim. The Seller is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, even if advised of the possibility. These limits do not apply to liability that cannot lawfully be excluded, including liability for fraud, death, or personal injury caused by negligence, or non-excludable rights under the Australian Consumer Law.

13. Indemnity

You agree to indemnify and hold harmless the Seller from any claim, damage, or cost (including reasonable legal fees) arising from your content, your use of the Service in breach of these Terms, or your violation of any law or third-party right.

14. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction over any disputes, without prejudice to any non-excludable rights you have under the laws of your own jurisdiction.
